Our Service Agreement

By receiving services from the Hoskia Website (www.hoskia.com), you will be deemed to have accepted all the conditions in this agreement. Hoskia, the preparers of all content on this site, its employees, and persons and organizations authorized by Hoskia have no criminal or legal liability for any material/moral damages that may arise from your failure to read these terms or to act in accordance with them even if you have read them. Hoskia has the right to update and change this agreement unilaterally at any time without prior notice. All information, statistical figures and values on the Hoskia Website are compiled from sources whose reliability is accepted within the framework of general practices, and their accuracy and adequacy are in no way guaranteed by Hoskia. Hoskia has no personal, legal or criminal liability for any direct or indirect material and/or moral negative and/or positive damages and possible other damages and expenses that may arise as a result of using the information, evaluations, comments and statistical figures and values on the Hoskia website. It is assumed and accepted by you that you have read the warnings and declarations in this agreement before receiving services from Hoskia, and in case of any dispute, claim and demand in this regard, it is declared by Hoskia and accepted and undertaken by the person(s) and organization(s) entering this Hoskia Website that these written statements on this web page and all other computer records belonging to Hoskia will be presented as the sole and exclusive evidence.

 

1.) Orders and Service Delivery Your account will be set up and your information will be sent to you after your order passes fraud checks and your payment is received. For payments made by credit card and PayPal, although domain, web hosting and reseller hosting accounts are set up automatically, in case of a problem, the setup process may take up to 48 hours. For payments made by transfer or EFT to our bank and postal check accounts, the setup time is set as a maximum of 2 business days. For VDS and dedicated server services, the setup time is 48 hours unless otherwise stated. The delivery time for software and license services is a maximum of 1 week unless otherwise stated in writing/orally. If delivery is not made within the specified time, Hoskia is obliged to refund your fee upon your request. It is your responsibility to provide an active, problem-free email address that you actively use when ordering. In case of any irregular behavior or when we need to reach you, the email address you provided will be used. It is your responsibility to keep your email address constantly updated and to check it; all emails sent to you are considered delivered. Hoskia has no legal or criminal liability for any damages that may occur if emails sent to you are not delivered or are not read by you. All information in the form you fill out during ordering or when registering on our site must be correct and complete. Hoskia has the right not to refund or partially refund fees for orders canceled due to incorrect information provided. Hoskia may request a photocopy/scanned image of a credit card or a photocopy/scanned image of an ID for security purposes when it deems necessary. If you do not provide these, your order may be canceled and treated as fraudulent or the service/services you have received may be suspended. Hoskia has the right not to refund or partially refund fees for accounts suspended due to fraud. Site Migration In services where site migration is guaranteed, Hoskia does its best to migrate your site to Hoskia. However, since site migration service is an uncertain process, Hoskia does not guarantee that your site will be migrated or how long it will take to migrate your site. Each hosting company has a different configuration and/or some hosting companies do not have the necessary conditions to migrate sites, so sometimes it can be very difficult or impossible to migrate your site correctly/completely/without errors. Your site may be migrated incorrectly and/or may not be migrated at all. Hoskia has no legal or criminal liability for damages that may arise from this situation.

 

2.) Content The conditions of all services provided by Hoskia are regulated according to the Constitution of the Republic of Turkey. By using the services provided by Hoskia, you cannot impose any legal liability on Hoskia; all legal responsibility for every action you take using the services provided to you belongs to you. It is prohibited to violate any copyright or registration rights using our services. These include unauthorized music, books, photos or other copyrighted materials. Also, according to laws, pornographic/erotic content and content that can be used for hacking cannot be hosted. Selling in violation of copyright/registration rights and/or hosting pornographic/erotic content will result in the immediate termination of the service/services you have received. If content that violates copyright/registration rights and/or content that can be used for hacking is encountered, this content will be deleted or access to the content will be blocked. Upon repetition, the service may be suspended/terminated. If you think that such content is hosted using the services provided by Hoskia, you can file a complaint by sending an email to support@hoskia.com. Hoskia may request more information/documents/documents from you regarding your complaint. In complaints regarding illegal actions carried out using the services provided by Hoskia, if Hoskia cannot verify the reason for the complaint or is not sure whether the action constitutes a crime, the service may not be terminated. Hoskia does not have the legal authority to make decisions. In such cases, you need to legally pursue your rights against the person who performed this action. Hoskia has no legal or criminal liability for any damages that may occur in such cases. All services offered by Hoskia are only for use within the limits permitted to you. If you somehow access content/files/services that you are not permitted to access, it is your responsibility to notify Hoskia without using it. Otherwise, you are responsible for covering any material/moral damages you may cause. Hoskia may monitor site content and/or any access for legal reasons, for system administration purposes, to track unauthorized access, to verify security procedures, and/or for operational security purposes. During monitoring, content/information may be tested, recorded, copied or used for the purposes described above. Hoskia does not use or share your content in any way for purposes other than those described above. Hoskia has the right to provide services to whoever it wishes or not to provide services to whoever it wishes. Hoskia has the right to delete/block access to content that violates the agreement, is provocative, divisive, illegal, or deemed inappropriate from our servers, with or without warning. In such cases, Hoskia has the right not to refund fees or to refund partially. Illegal content will be reported to authorized units. Uploading virus-infected content and content such as shell scripts that may damage Hoskia servers may result in the complete termination of your account without refund. You are obliged to cover all material/moral damages caused to Hoskia and/or other users through these methods. Ensuring the security of your account is entirely your responsibility. In the services you receive from Hoskia, you are responsible for ensuring that the software/scripts/programs uploaded to your account are secure and that the permissions given to directories are correct. Users are responsible for every transaction made in their own accounts. This responsibility also includes the username and password. You should use a secure and unpredictable password for your accounts. Also, you are responsible for all malicious software that will be uploaded to our servers in any way using your account. When necessary, Hoskia has the right to terminate your services without refund or with partial refund. Hoskia will not accept any legal or criminal liability for material/moral damages that may occur in this regard. You are obliged to cover all material/moral damages caused to Hoskia and/or other users using your account. Hoskia has the right to request from you the modification of any website, database, account, or any other material/service.

 

3.) SPAM Prohibition Hoskia absolutely does not tolerate unwanted email sending, mass email sending, and spam emails. If you do not comply with this matter, the service/services you have received will be terminated with/without notice. All services that cause our IP block to enter email blacklists will be terminated without notice. If the IP block enters email blacklists, Hoskia has the right to request the necessary fee from the person who caused this situation to correct it. This fee is independent of Hoskia and will be used to clean the IP block from email blacklists. By receiving service from us, you agree that in such cases, you will pay the necessary fee within the requested period without objection.

 

4.) Payment As long as you receive service from Hoskia, you agree to pay the fee for the service you receive to Hoskia. Unless you cancel the service you have received, the service will continue to be renewed and an invoice will be created for the service you will receive. If you do not wish to continue receiving services, you must state that you wish to cancel at least 15 days in advance, so your service will be canceled at the end of the day or after the period you have paid for, according to your request. Service cancellation must be done through your customer panel. On the cancellation page, there are necessary options to cancel the service immediately or when its term expires. If not canceled 15 days in advance, for accounts whose payment is not made, Hoskia has the right to obtain the fee through legal means. As long as you receive service from Hoskia, you have the responsibility to ensure that your payment information is up to date and to pay your invoices on time. If the invoice is not paid on time, Hoskia will give an additional 6 days for the payment of the invoice for web hosting and reseller hosting accounts, and after this period, your service will be suspended. 30 days after the last payment date, the service you have received will be terminated. For domain, VDS and dedicated server services, if payment is not made on the last payment day, your accounts will be terminated immediately. Hoskia cannot be held responsible in any way for material/moral damages that may arise in this regard and possible data losses. Overpayments made mistakenly and/or knowingly are added to your account as credit and are not refunded for any reason. You can use this added credit for subsequent services you will receive from Hoskia. Hoskia reserves the right to change the prices of products at any time without notice. If the disk space, traffic and similar resources you purchase are used more than the purchased amount, Hoskia will request the fee for the used resources from you. In such a case, you have the responsibility to pay the necessary fee within the requested period without objection. If not paid, your account will be terminated without refund and Hoskia will not be responsible for material/moral damages and data losses that will occur in this regard. In cases where fee withdrawal (dispute, chargeback, etc.) is made using payment channels without the knowledge and/or permission of Hoskia, you are responsible for covering all material and moral damages caused to Hoskia.

 

5.) Backup and Data Loss While using our services, you are responsible for all your data. Hoskia offers the backup service as a convenience to you and absolutely does not guarantee backups. Hoskia cannot be held responsible for data losses you may experience for any reason.

 

6.) Service Cancellation and Refund Hoskia reserves the right to terminate any service at any time, with or without notice, without refund or with partial refund, without showing cause, without notice. Insulting any of our employees/exhibiting rude behavior will cause your account/service/services you have received to be suspended/terminated. In such a case, your membership will be terminated and the agreement will be terminated without any refund. By receiving service from Hoskia, you undertake to refrain from all kinds of comments, behaviors, announcements, posters, writings, words, etc. that damage the commercial reputation of Hoskia or its employees. You accept that in case of contrary behavior, you are under material-moral compensation obligation and that Istanbul Courts and Enforcement Offices are authorized in all lawsuits to be filed in this case. Sites that directly or indirectly damage our servers and/or cause problems such as slowdown/interruption and sites under attack may be terminated without notice and without refund. In such cases, Hoskia may request you to cover the damage incurred. In such a case, you have the responsibility to pay the necessary fee within the requested period without objection. For services that have been paid for, if the service is canceled before the service period expires (due to use contrary to the service agreement, user request, etc.), the entire service fee or the fee for the unused period will not be refunded. You can use the credit in your account for services you can receive from us, but no refund will be made or credit will be added to your account for services that will be terminated early.

 

7a.) Service Usage 7aa.) Web Hosting/Reseller Hosting Prohibited actions: a) Sending mass emails and SPAM emails for any reason, in any way, is strictly prohibited. Email services are provided for your use only for your normal correspondence. b) Resource usage above 25% for longer than 90 seconds is prohibited. There are many activities that can cause problems, including CGI software, FTP, PHP, HTTP, etc. Resource usage reports are detected by Hoskia and Hoskia is not obliged to present any evidence regarding your resource usage. c) For web hosting accounts, average resource usage of more than 5% daily, for reseller hosting accounts, average resource usage of more than 12% daily is prohibited. There are many activities that can cause problems, including CGI software, FTP, PHP, HTTP, etc. Resource usage reports are detected by Hoskia and Hoskia is not obliged to present any evidence regarding your resource usage. d) Running any server-based programs on our servers is prohibited. This includes server-based programs such as IRCD. e) Running spider or indexer programs such as Google Cash/AdSpy is prohibited. f) Running any software that communicates with IRC (Internet Relay Chat) networks is prohibited. g) Running any proxy application is prohibited. h) Running any bit torrent application is prohibited. You can link to legal torrents outside our servers but you cannot host them on our servers. i) Any file sharing/peer-to-peer application cannot be run. j) Game server applications such as Counter-Strike, Half-Life, etc. are prohibited. k) Running cronjob applications at intervals shorter than 15 minutes is prohibited. l) Running file sharing software is prohibited (example: rapidshare, etc.). ı) Running audio stream/video broadcast applications is prohibited. i) Each web hosting account is limited to a maximum of 250,000 files. Accounts with more than 100,000 files are not backed up by us. 7ab.) VDS/Dedicated Server Prohibited actions: a) Sending mass emails and SPAM emails for any reason, in any way, is strictly prohibited. Email services are provided for your use only for your normal correspondence. b) In VDS services, intensive resource usage that will damage other VDSs in any way cannot be made. This problem is usually caused by intensive disk activities. c) Running any proxy application is prohibited. d) Running any bit torrent application is prohibited. You can link to legal torrents outside our servers but you cannot host them on our servers. e) Any file sharing/peer-to-peer application cannot be run. j) Game server applications such as Knight Online, Counter-Strike, Half-Life, etc. are prohibited. 7b.) Backup Limit Services of customers who continuously make backups that Hoskia deems unnecessary may be suspended/terminated with/without notice. This article applies if the backup service is used for purposes other than backup and damages the server. 7c.) Unlimited Web Hosting a) Unlimited web hosting services only cover hosting your website files and only your website's traffic. b) Unlimited web hosting space cannot be used for data storage and/or backup purposes. 8.) Traffic Usage You will have a certain traffic limit according to the package you purchase. If this limit is filled/exceeded, the purchased service/services may be automatically suspended until the next month or until more traffic is purchased. Monitoring the traffic used is your responsibility. Unused traffic cannot be carried over to the next month. Usage above the traffic you purchased will be billed the following month and you agree to pay this fee within the requested period without objection. 9.) Uptime Guarantee If the 99% uptime guaranteed by Hoskia is not fulfilled, Hoskia is responsible for providing one month of free use for the relevant service upon your request. Uptime reports reported by third-party monitoring software are not valid for Hoskia; Hoskia maintains and publishes uptime reports itself. To have credit added to your account when the uptime guarantee is not fulfilled, you must send an email to support@hoskia.com. In VDS and dedicated server services, only the network is guaranteed; Hoskia is not responsible for your VDS or dedicated server being operational and/or accessible. In such cases, Hoskia will not be aware of the problem unless you notify us. The discount provided in VDS/Dedicated server services when the uptime guarantee is not fulfilled does not cover 3rd party software/license fees. The uptime guarantee is not valid during attacks on the server by malicious persons for the purpose of keeping the server down and during previously announced server maintenance. Downtime occurring for this reason will not be reflected in the uptime rate. 10a.) Support Scope You agree that Hoskia will not provide any support on issues not covered by the service you have received. Hoskia has no obligation to provide software support and perform user operations (opening mail accounts/configuring mail settings, creating databases, etc.) for any hosting service received. In VDS/dedicated server services, support is only provided for restoring the system to its initial delivered state; additional software installations-user operations are not within the scope of support. In software services, Hoskia is only obliged to deliver software that works without problems. To benefit from the support system, you must log in to your customer panel with your password and send a support ticket from the Support Tickets section. No information about the account is shared and no transaction is performed through other means (email, phone, live support, contact form, etc.). 10b.) 7/24 Support and Support Provision Time The concept of 7/24 support does not mean that you will reach us every time you call or receive immediate responses to your support tickets. Our support team tries to respond to your tickets as quickly as possible. 7/24 support indicates that work is done without being bound by business hours and the response you will receive to your support ticket is a maximum of 24 hours, depending on the workload of the support team, unless exceptional circumstances occur. 11.) Reseller Hosting: Customer Responsibility If you purchase a reseller hosting account, you are responsible for providing support to your own customers. Hoskia will not provide support to the customers of reseller hosting users. If any customer of our reseller hosting user contacts us, Hoskia has the right to suspend your account until you deal with your own customer. Also, our reseller hosting users are responsible for the content of their customers' sites themselves. Hoskia cannot be held responsible in any way for illegal behaviors of reseller hosting users' customers and behaviors contrary to the agreement.

 

12.) VDS and Dedicated Server Hoskia reserves the right to reset the password of any VDS or dedicated server service it provides. It is the customer's responsibility to maintain a valid email address and root password in our system. VDS and dedicated servers are not backed up by us; all data and data backup are the customer's responsibility. 13.) Co-Location (Server Hosting) Hoskia reserves the right to reset the password of any server in any server hosting service it provides. It is the customer's responsibility to maintain a valid email address and root password in our system. Hosting services are not backed up by us; all data and data backup are the customer's responsibility. In case of payment delays in server hosting services, Hoskia reserves the right to retain the hosted server and other equipment as collateral until payment is made along with legal interest. 14.) Price Change For the service you have purchased, during the service period you have purchased, unless you purchase an additional feature or use beyond the limits permitted to you, no additional fee will be requested from you. Hoskia reserves the right to change prices at the end of the service period and renew the service with the new pricing. 15a.) Damage Compensation By receiving service from Hoskia, you agree that you will not damage Hoskia in any way, will not cause any material/moral damage, and undertake to compensate any material/moral damage caused. 15b.) Legal Obligations By receiving service from Hoskia, you agree not to impose any legal obligations on Hoskia. In such a case, you undertake to cover all court and attorney fees within the requested period. 16.) Disclaimer Hoskia cannot be held responsible for any damage your business may suffer. Hoskia does not offer any guarantees regarding the service/services it provides. These also include data losses, delays, interruptions, incorrect information delivery caused by Hoskia and any Hoskia official. Hoskia will not accept responsibility if your data/information is obtained by 3rd parties in a possible hacking incident.

 

17.) Legal Information Disclosure Hoskia is obliged to provide any information requested by legal authorities when necessary. This information may include your private information when necessary.
